Color Moon provides this website, including the information, content, features, tools, products and services available, to offer customers an online shopping experience.

Our store uses the Shopify platform, which allows us to offer and manage these services.

These Terms and Conditions, together with the policies referred to in this document, govern access to the store, use of the website and purchases made.

Before using the store or placing an order, you must carefully read these Terms and Conditions, our Privacy Policy, our Returns and Refunds Policy and our Shipping Policy.

By accessing the store or placing an order, you accept these Terms and Conditions. If you do not agree, you should not use our services.

Accepting these terms does not mean waiving any mandatory consumer rights under applicable law.

By placing an order, you declare that you have sufficient legal capacity to enter into a sales contract and that the information provided is correct, current and complete.

4. Customer accounts

You are responsible for providing correct and current information, protecting your login credentials, not sharing your password with third parties, and notifying us of any unauthorized access to your account.

You may not transfer, sell or assign your account to another person.

5. Product information

We make every effort to display product characteristics, composition, sizes, designs, colors, images and descriptions as accurately as possible.

However, displayed colors may vary slightly depending on the screen, brightness, settings or device used. These minor display differences do not affect the product’s essential characteristics or limit consumers’ legal rights.

6. Availability

All orders are subject to product availability. A product appearing in the store does not guarantee that it will remain permanently available.

If we discover after purchase that a product is unavailable, we will contact you to offer an alternative or cancel the affected item and refund the corresponding amount in full.

We may limit quantities per order when necessary to prevent fraudulent purchases, inventory errors or purchases intended for unauthorized resale.

7. Purchase process

To make a purchase, select the product; choose the correct size, design and quantity; add the product to your cart; provide billing and delivery details; select a payment method; review the order; accept the applicable terms; and complete payment.

You are responsible for checking the size, design, delivery address and other details before completing the order.

After purchase, an order confirmation will be displayed or sent to you. This confirms that we have received your purchase request.

The contract is concluded when the order has been accepted and payment has been processed successfully.

8. Acceptance and cancellation of orders

We may reject or cancel an order for justified reasons, including lack of availability, inability to process payment, incomplete or incorrect delivery details, reasonable indications of fraud, legal restrictions on shipping to the destination country, an obvious error in the price or product information, or breach of these Terms and Conditions.

If we cancel an order after receiving payment, we will refund the amount paid in full through the same payment method used.

We will try to communicate any issue using the email address or other information provided with the order.

We cannot guarantee cancellation once preparation has started. If the order has already shipped, a return must be requested under our Returns and Refunds Policy.

9. Personal use of products

Purchasing through fraudulent or automated means, or for commercial resale without prior authorization, is not permitted.

We may limit or reject orders that, because of their quantity, frequency or other circumstances, appear intended for unauthorized resale.

10. Prices

The applicable prices are those displayed in the store when the order is confirmed.

Before payment, the total purchase amount will be shown, including applicable taxes and charges that must be disclosed under the relevant law.

Prices may change without notice, but changes will not affect orders already confirmed.

Online store prices may differ from those offered by external sellers or through other channels.

Where a crossed-out former price, discount percentage or promotion is displayed, the offer’s stated conditions and period apply.

If there is an obvious pricing error that is clearly disproportionate to the product’s actual value, we may contact you before dispatch to offer the option of keeping the order at the correct price or cancelling with a full refund.

11. Promotions and discounts

Promotions, discounts, product packs and quantity offers may be subject to specific conditions, availability and limited duration.

Where a promotion has its own conditions, those conditions take priority only for that promotion.

Discount codes cannot be exchanged for cash, used after expiry, or combined unless stated otherwise. They may be limited to certain products, countries or quantities and cannot be applied retroactively to orders already placed.

Products purchased during a promotion or at a discount retain all mandatory consumer rights.

12. Payment methods

Available payment methods are displayed during checkout. Payments are processed through Shopify and the payment providers enabled in the store.

By providing payment details, you declare that the information is true and complete, you are authorized to use the selected payment method, sufficient funds are available, and the transaction is not for fraudulent or unlawful purposes.

Color Moon does not directly store full card details where payments are processed by external payment providers.

13. Shipping and preparation

Orders are normally prepared within 1–3 business days.

After preparation and dispatch, estimated delivery is 7–12 business days, unless another period is stated on the product page or during checkout.

Delivery times are estimates and may be affected by periods of high demand, public holidays, carrier incidents, customs inspections, weather, errors in the address provided, or exceptional circumstances outside our control.

An estimated delivery period does not remove our responsibility to deliver within the agreed or legally applicable period.

14. Delivery address

You must provide a complete, correct and accessible delivery address.

Color Moon is not responsible for delays caused by incorrect or incomplete information supplied by the customer. However, we will try to help correct the address if the order has not yet shipped.

If an order is returned because the address was incorrect or incomplete, or delivery could not be completed for a reason attributable to the recipient, we will contact you about the available options.

Any additional cost must be reasonable, justified and consistent with mandatory consumer rights.

15. Transfer of risk

Color Moon remains responsible for the order until you, or a person authorized by you other than the carrier, physically receives the product.

Risk of loss or damage does not pass to you simply because the order has been handed to the shipping company.

If you independently appoint a carrier that was not offered by Color Moon, risk may pass when the product is handed to that carrier, in accordance with applicable law.

16. Customs and international orders

We ship to the countries available during checkout.

International orders may be subject to customs inspections, restrictions or taxes imposed by the destination country.

Available information about the price and applicable costs will be displayed before purchase is completed.

Where duties, import taxes or customs charges legally payable by the recipient are not included in the price, their application depends on the destination country’s rules.

You are responsible for checking that the product can legally be imported into your country.

These conditions do not limit mandatory consumer rights or allow costs legally payable by the seller to be imposed on the customer.

17. Returns, withdrawal and refunds

Returns, cancellations and refunds are governed by our Returns and Refunds Policy.

Color Moon offers a commercial return-request period of 30 calendar days from receipt of the order, subject to that policy’s published conditions.

Consumers in the European Union have, at a minimum, the legal right of withdrawal applicable to distance purchases.

Our 30-day commercial policy does not limit mandatory rights under the law of the consumer’s country of residence.

18. Damaged, defective or incorrect products

Please inspect the order after receipt.

If a product arrives broken, stained, defective, incomplete or different from what was ordered, contact pintaluna.info@gmail.com as soon as possible and include photographs of the product and packaging.

Color Moon will investigate the issue and provide the appropriate solution under applicable law.

Damage caused later by misuse, incorrect washing, handling, normal wear or failure to follow care instructions is not considered an original defect.

Nothing in these terms limits consumers’ legal rights where a product does not conform to the contract.

19. Intellectual property

Store content, including text, designs, original photographs, videos, logos, graphics, trading names, visual elements and website organization, is protected by intellectual and industrial property laws.

This content belongs to Color Moon or is used with the permission of its respective owners. Access to the store does not give users ownership rights over it.

Without prior authorization, you may not copy or reproduce content commercially; modify or distribute store materials; use the Color Moon name, logo or design in a way that creates confusion; extract content in bulk; create derivative products based on protected material; or use store photographs, videos or commercial descriptions to sell unrelated products.

Shopify and third-party names, logos and trademarks belong to their respective owners.

Color Moon operates through Shopify, which provides the technology infrastructure needed to offer our services.

Using Shopify does not exclude or reduce Color Moon’s legal responsibilities as the seller.

Color Moon is not responsible for losses caused exclusively by unlawful use or use contrary to instructions; incorrect information provided by the customer; actions of third parties entirely outside our control, without prejudice to our responsibilities as the seller; or force majeure that could not reasonably have been foreseen or prevented.

Where you act as a consumer, no limitation will be interpreted to the detriment of your mandatory rights.

30. Force majeure

A delay caused by extraordinary events reasonably beyond our control, such as natural disasters, conflicts, official closures, serious transport disruptions, public health emergencies or widespread infrastructure failures, will not be regarded as a breach.

If such an event significantly affects an order, we will inform you and offer the options required by law.

31. Severability

If a provision is declared unlawful, void or unenforceable, it will be interpreted or limited as necessary to comply with the law.

The invalidity of one provision will not affect the remaining provisions, provided the contract can continue without it.

32. No waiver

In the event of a conflict, the specific condition most favorable to the consumer will apply where the law requires it.

34. Assignment

You may not transfer rights or obligations arising from a purchase where this is incompatible with their nature or the law.

Color Moon may assign rights or obligations arising from its business only where this does not reduce guarantees or prejudice consumers’ rights.

35. Applicable law and jurisdiction

These Terms and Conditions are governed by Spanish law.

If you act as a consumer and live in another country, you also retain the mandatory rights granted by the law of your place of residence.

Any dispute will be submitted to the courts competent under applicable law.

Consumers are not required to waive the courts corresponding to their domicile or accept a jurisdiction other than the one legally applicable.

36. Changes
